Terms & Conditions

These Terms and Conditions explain your rights and obligations. Please read them carefully. You may have other rights granted by law and these Terms and Conditions will not affect those except if the two are inconsistent. If this is the case then these Terms and Conditions will override any other rights that you may have, unless this is not permitted by law.

These terms and conditions regulate the Agreement between "you" the customer and My Shisha Pen.

1. My shisha Pen’s Contact Details.

1.1 MY SHISHA PEN  is a company Trading as EMSP LTD registered in England and Wales under Company Number 08697584. This was registered electronically and authenticated by the Registrar of Companies House, Cardiff, UK under section 1115 of the companies Act 2006.

1.2 If you have any complaints about our service or any goods or service you purchase from us please get in touch via the Contact page.

1.3 When you visit this site or send emails to us you are communicating with us electronically. We communicate with you by email or by posting notices on the site. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

2. Privacy.

My shisha Pen are committed to protecting your privacy. We will only use the information collected from you lawfully (in accordance with the Data Protection Act 1998).

We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service. The type of information we collect about you includes: your name, address, phone number and e-mail address. We will not pass on your details to any third parties.

The personal information which we hold will be held securely in accordance with the law.

3. Responsibility For Product Use.

3.1 You hereby take full responsibility for the use of your My Shisha Pen product.

3.2 My Shisha Pen’s e-liquids may contain nicotine, propylene glycol, glycerol, water and edible flavouring. If you are taking medication or suffer from any medical conditions you should consult a doctor before using My Shisha Pen’s products. In rare cases, ingredients may cause sensitivity, please do not use My Shisha Pen’s products if you are allergic to any of the ingredients listed.

3.3 Some of My Shisha Pen’s products may contain nicotine which is an addictive, habit forming substance and is a stimulant.

3.4 All of My Shisha Pen's products should be kept out of reach of children and animals as nicotine consumption can be fatal. Components can become hot if used excessively, are left in an open environment or if misused. My Shisha Pen shall not be responsible for any loss, liability, damage (whether direct or indirect), harm, personal injury, medical condition, allergic reaction or expense of any nature whatsoever suffered by you or any third party as a result of using our products.

3.5 My Shisha Pen’s products are not intended to treat, cure or prevent any illness or disease. Electronic cigarettes are an alternative to smoking and are not sold as a cessation method.

4. Purchasing From Us.

4.1 To purchase from us you must be over 18.

4.2 When you place an order to purchase a product from us you will be sent an e-mail confirming receipt of your order and setting out the details of your order. Personal details you provide must be complete and correct.

4.3 By submitting your order you are offering to buy the goods at the price set out in the order and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to couriers and other subcontractors in order for us to fulfill your order).

4.4 You do not own the goods until we receive payment in full.

4.5 If you discover you have made a mistake with your order please contact us immediately. Please do this before we confirm your order. We are unable to rectify mistakes after this time, although you still have the right to cancel described in clause.

5. Availability.

Availability details are provided for each item on the relevant webpage. These details are checked regularly but may not always be current at the time of ordering. If we find the availability of an item has changed when we receive your order we will inform you by email of any items within your order that are unavailable.

6. Ownership And Title.

All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product leaves our premises in the UK.

7. Delivery.

7.1 When your items have been sent, you will be sent an e-mail by myshishapen.co.uk confirming your order and a tracking number for you to track your items. All items are sent by Royal Mail 1st Class Recorded Delivery (signature required).

7.2 Items sold by us on our myshishapen.co.uk website are despatched from the UK to destinations across the world. The shipping cost will increase for destinations outside of the UK. My Shisha Pen are in no way responsible for the detention of any goods by any countries, associated customs or legal departments.

7.3 We aim to deliver goods to you within the time indicated by us in our acceptance but we cannot give an exact delivery date. If you have not received your goods within 16 days of the date given in our acceptance then you may cancel the contract and we will refund any money paid by you.

8. Customs.

If your delivery address is outside the UK, the addressee will be the importer of record and must comply with all laws and regulations of the country into which the products are delivered. The product may be subject to import duties and taxes, which are levied once the package reaches the country of delivery. Any such additional charges levied for customs clearance must be borne by you. Please note that we have no control over these charges and cannot predict what they may be at any time in the future.

9. Returns And Cancellation Policy.

9.1 PLEASE NOTE: My Shisha Pen only offer a warranty on faulty products. My Shisha Pen do not offer a warranty, ie. if you do not like the product you may not return it.

9.2 Please check all goods when you receive them as the warranty will run from the date of your receipt and the warranty only applies on faulty products.

9.3 You will have 14 days from the date of receipt to cancel your order. You can return the order to us unopened and in its original condition to receive account credit or a full refund (customer to pay shipping costs).

9.4 The following procedure must be followed in order to carry out a warranty claim:

  • Email: info@myshishapen.co.uk informing us of the Order ID (or your full name) and a reference to the item in question
  • A copy of the returns form will be sent out to you.  Please note that failure to fill out the returns form can result in a delay in processing any warranty items.
  • Once the goods are received My Shisha Pen will test and inform you of the findings.
  • If the goods are found to be faulty then we will immediately ship out replacement items or apply store credit to the account holder or issue a refund.
  • Please allow 5 working days for accurate testing and a response.

9.5 If you do not wish to wait for the warranty procedure to be carried out you may make an additional purchase for the replacement item.  If the original item was found to be faulty after testing then a full refund will be issued.

9.6 The warranty will be void if the returned goods have not been suitably maintained or kept clean.

10. Alteration Of Service Or Amendments To The Conditions.

We reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

11. Events Beyond Our Reasonable Control.

We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your statutory rights.

12. Waiver.

If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

13. Governing Law And Jurisdiction.

Your relationship with us is governed by and construed in accordance with the laws of England. The Courts of England shall have exclusive jurisdiction over any disputes arising out of these Terms.
